EmploymentOffice.org Web Agency
Terms of Use
Effective Date: August 30, 2026
1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of webagency.employmentoffice.org and related pages, forms, demonstrations, content, communications, and digital features made available by Epic Innovative Enterprises, LLC (“Epic,” “we,” “us,” or “our”) (collectively, the “Site”).
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Site.
If you access or use the Site on behalf of a business, organization, or other entity, you represent that you have authority to act on behalf of that entity and bind it to these Terms to the extent permitted by law.
2. About the Site and Services
Epic Innovative Enterprises, LLC provides web design, website development, website redesign, consultation, website support, optimization, and related digital services through the Site (collectively, the “Services”).
Information presented on the Site may describe Services, capabilities, processes, pricing structures, examples, demonstrations, and general business offerings.
Nothing on the Site obligates Epic to accept a project, enter into a client relationship, provide any particular Service, meet any particular schedule, or perform work at any particular price unless separately agreed to in writing.
3. Site Terms and Client Agreements
These Terms govern use of the Site. They do not replace a proposal, statement of work, service agreement, order form, invoice, or other written agreement governing a specific client project (“Client Agreement”).
A client relationship does not arise merely because you submit an inquiry, request information, participate in a consultation, receive an estimate, or otherwise communicate with us.
Project scope, pricing, payment requirements, revisions, deliverables, schedules, ownership, warranties, liability limitations, cancellations, and other project-specific requirements may be governed by a separate Client Agreement.
If a valid Client Agreement conflicts with these Terms with respect to a particular paid project, the Client Agreement will control that project to the extent of the conflict.
4. Eligibility and Authority
The Site and Services are intended primarily for adults, businesses, organizations, and professionals.
By submitting a commercial inquiry or entering into a transaction, you represent that you have legal capacity to do so or authority to act for the applicable business or organization.
5. Project Inquiries, Pricing, and Estimates
Information submitted through forms, email, consultations, or other communications may be used to evaluate a potential project.
Unless expressly identified as binding in writing, estimates, preliminary recommendations, anticipated schedules, availability statements, pricing discussions, or proposed approaches are informational and subject to change before execution of a Client Agreement.
Prices displayed on the Site may represent package prices, starting prices, examples, or standard service structures. Actual project pricing may vary based on scope, complexity, functionality, content, integrations, timing, third-party expenses, revisions, and other requirements.
6. No Guarantee of Business or Marketing Results
Websites and digital services may support business and marketing goals, but results depend on numerous factors outside Epic’s control.
Unless expressly guaranteed in a signed Client Agreement, Epic does not guarantee any particular:
- Revenue or profit
- Sales or transactions
- Leads or inquiries
- Calls or bookings
- Website traffic
- Search-engine ranking or indexing
- Conversion rate
- Advertising performance
- Audience growth or engagement
- Customer acquisition result
- Business, financial, or commercial outcome
Portfolio materials, demonstrations, estimates, examples, projections, discussions, or past results do not guarantee future performance.

The Site or Services may from time to time contain or experience errors, omissions, typographical mistakes, inaccurate information, broken links, bugs, interruptions, compatibility issues, delayed updates, or other defects.

These services are controlled by their respective providers. Their availability, pricing, functionality, terms, security, compatibility, policies, and continued operation may change without Epic’s control.
To the fullest extent permitted by applicable law, Epic will not be responsible for outages, failures, suspensions, data loss, security incidents, discontinued functionality, policy changes, price changes, account restrictions, incompatibilities, or other acts or omissions attributable to independent third parties.

9. Client and User Responsibilities
Users and clients are responsible for supplying accurate, complete, lawful, and timely information reasonably necessary to provide requested Services.
Client responsibilities may include providing approvals, content, photographs, trademarks, credentials, platform access, business information, product information, legal disclosures, pricing, policies, and other materials.
Epic is not responsible for delays, errors, omissions, additional expenses, missed deadlines, or other consequences caused or materially contributed to by delayed client responses, inaccurate information, missing materials, withheld access, delayed approvals, unpaid amounts, scope changes, or other matters outside Epic’s reasonable control.
Clients are responsible for reviewing deliverables and identifying requested corrections, errors, omissions, or concerns within any applicable review period.
10. Client-Provided Content and Intellectual Property
If you provide text, photographs, graphics, videos, logos, trademarks, fonts, software, documents, data, music, or other materials, you represent that you own those materials or possess sufficient rights and permissions to authorize their use.
You are responsible for the accuracy, legality, ownership, licensing, and appropriateness of materials you provide.
Unless expressly agreed otherwise in writing, Epic has no obligation to independently investigate or verify the ownership, licensing, factual accuracy, regulatory compliance, trademark status, copyright status, or legality of every item supplied by a client.
11. Client Legal and Regulatory Compliance
Unless expressly provided under a separate professional engagement, Epic does not provide legal, tax, accounting, regulatory, or compliance advice.
Clients remain responsible for determining which laws, regulations, licenses, disclosures, notices, consent mechanisms, industry standards, accessibility requirements, privacy obligations, advertising rules, ecommerce obligations, and other legal requirements apply to their businesses and websites.
Templates, sample policies, suggested language, technical features, checklists, or general information are not substitutes for advice from qualified legal or other professional advisers.
12. Accessibility
Epic supports efforts to provide accessible digital experiences and may use accessibility-conscious design practices where appropriate.
Accessibility requirements may depend upon applicable law, industry, content, jurisdiction, technology, client modifications, and third-party services.
Unless a specific accessibility standard, audit, remediation obligation, or compliance requirement is expressly included in a Client Agreement, Epic does not represent or warrant that a client website has achieved any particular legal certification or level of accessibility compliance.
13. Search Engines and SEO
Search engines independently control crawling, indexing, rankings, algorithms, search features, penalties, and search-result presentation.
Unless expressly guaranteed in a Client Agreement, SEO-related Services do not guarantee indexing, ranking position, traffic, conversions, continued placement, or any particular search-engine result.
14. Portfolio, Demonstrations, and Sample Websites
The Site may display portfolio examples, demonstrations, sample websites, concepts, mockups, prototypes, or other illustrative materials.
These materials may be created to demonstrate design capabilities, industries, styles, functionality, or possible approaches and may not represent active clients, actual businesses, or completed commercial projects unless expressly identified otherwise.
Demonstration websites may contain sample names, text, photographs, products, pricing, testimonials, contact details, or other illustrative information. Such information should not be relied upon as factual information concerning an actual business unless expressly stated.
15. Epic Intellectual Property
Unless otherwise stated or governed by a Client Agreement, original Site content, graphics, text, designs, interfaces, layouts, code, demonstrations, branding elements, and other materials are owned by Epic, licensed to Epic, or otherwise used with permission.
You may not reproduce, republish, sell, distribute, modify, misappropriate, or commercially exploit protected Site materials without appropriate authorization.
Ownership and licensing of deliverables created for a specific paid project will be governed by the applicable Client Agreement.
16. Feedback
If you voluntarily provide general feedback, suggestions, ideas, or recommendations concerning the Site or Services, Epic may use that feedback for legitimate business purposes without an obligation to compensate you, provided this does not transfer ownership of your confidential information or client-owned materials.
17. Prohibited Conduct
You agree not to use the Site to:
- Violate applicable law
- Commit fraud or materially misrepresent identity or authority
- Transmit malicious code, malware, or harmful software
- Attempt unauthorized access to systems or accounts

- Use automation in a manner that materially disrupts Site operation
- Exploit protected Site content without authorization
- Use the Site for unlawful, deceptive, abusive, or malicious activity
We may restrict access when we reasonably believe use violates these Terms, threatens security, disrupts operations, or creates material risk to Epic or others.
18. Third-Party Links
The Site may contain links to independent third-party websites, applications, platforms, or resources.
Unless expressly stated otherwise, a link does not constitute our endorsement, guarantee, sponsorship, or control of that third party.
Epic is not responsible for the availability, security, privacy, accuracy, products, services, content, or conduct of independent third-party services.
19. Site Availability and Modification
Epic may modify, update, suspend, restrict, discontinue, replace, or change all or part of the Site or its features at any time, subject to applicable law and any separate contractual obligations.
We do not guarantee uninterrupted or continuous availability of the Site.
20. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site, its content, and general information made available through the Site are provided “as is” and “as available,” with all faults.
To the fullest extent permitted by applicable law, Epic disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, compatibility, and uninterrupted operation.
Nothing in these Terms excludes or limits a warranty, right, or protection that cannot lawfully be excluded or limited.
21. Exclusion of Certain Damages
To the fullest extent permitted by applicable law, Epic Innovative Enterprises, LLC and its owners, officers, employees, contractors, representatives, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages arising from or relating to the Site or these Terms.
This exclusion includes, to the fullest extent permitted by law, loss of profits, loss of revenue, loss of sales, loss of business, loss of business opportunity, loss of anticipated savings, loss of goodwill, loss of customers, business interruption, reputational harm, or loss, corruption, or inability to access data.
22. Maximum Liability for Use of the Site
To the fullest extent permitted by applicable law, the aggregate liability of Epic Innovative Enterprises, LLC and its owners, officers, employees, contractors, representatives, agents, affiliates, licensors, and service providers for all claims arising out of or relating to use of the Site, these Terms, Site content, or any matter governed solely by these Terms will not exceed one hundred United States dollars (US $100).
This aggregate limit applies regardless of the number of claims, events, theories of liability, or parties asserting claims and regardless of whether a claim is asserted in contract, tort, negligence, strict liability, statute, or another legal theory, to the extent such limitation is permitted by applicable law.
This $100 limitation applies to claims governed solely by these Site Terms. Liability arising from paid client Services may instead be governed by the limitation-of-liability provisions contained in the applicable Client Agreement.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
23. Third-Party and External Events
To the fullest extent permitted by applicable law, Epic will not be responsible for losses caused by or materially attributable to independent third-party platforms, hosting services, domain providers, telecommunications networks, software, plugins, APIs, payment systems, search engines, social platforms, cybersecurity incidents involving independent systems, or other services outside Epic’s reasonable control.
24. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Epic Innovative Enterprises, LLC and its owners, officers, employees, agents, contractors, and affiliates from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your unlawful use of the Site
- Your material violation of these Terms
- Content or materials you submit in violation of another person’s rights
- Your infringement or misappropriation of third-party intellectual property
- Your fraudulent, malicious, or intentionally wrongful conduct
Project-specific indemnification obligations may be governed separately by a Client Agreement.
25. Events Beyond Reasonable Control
To the extent permitted by applicable law, Epic will not be liable for delay, interruption, or failure caused by events reasonably outside its control, including natural disasters, severe weather, fire, flood, epidemic or pandemic conditions, acts of war or terrorism, civil unrest, government action, labor disruptions, widespread internet or telecommunications failures, electrical outages, cyber incidents, third-party platform outages, hosting failures, supplier failures, or similar events.
26. Privacy
Our collection and handling of personal information in connection with the Site is described in our Privacy Policy.
27. Governing Law
Except where applicable law requires otherwise or a separate Client Agreement controls, these Terms and disputes arising out of or relating to these Terms or use of the Site are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
28. Informal Dispute Resolution
Before commencing arbitration or other formal proceedings concerning a dispute arising from these Terms, the complaining party must make a reasonable good-faith effort to resolve the matter informally.
Written notice should describe the nature of the dispute, relevant facts, and the requested resolution and should be sent to: legal@employmentoffice.org .
The parties should allow at least thirty (30) days after receipt of the notice for a good-faith attempt at informal resolution before commencing arbitration, except where immediate action is reasonably necessary to preserve a legal right or obtain emergency relief.
29. Arbitration Agreement
Except where prohibited by applicable law, where a separate written agreement establishes another dispute procedure, or where a qualifying claim may properly be pursued in small claims court, disputes arising out of or relating to these Terms or use of the Site that cannot be resolved informally will be resolved by binding arbitration rather than a trial before a judge or jury.
Arbitration will be conducted on an individual basis in accordance with applicable arbitration law and the procedures of a mutually acceptable arbitration provider or other legally valid process.
Unless the parties agree otherwise or applicable law requires otherwise, arbitration will occur remotely or within the State of Texas.
The arbitrator may award relief available under applicable law, subject to valid contractual limitations contained in these Terms.
An arbitration provision contained in a separate Client Agreement will control disputes governed by that Client Agreement.
Nothing in this section prevents a party from seeking temporary, emergency, or equitable relief where legally appropriate to protect intellectual property, confidential information, systems, accounts, security, or other rights pending resolution of a dispute.
30. Individual Proceedings and Class-Action Waiver
To the fullest extent permitted by applicable law, disputes subject to arbitration must be brought and resolved on an individual basis and not as a plaintiff or class member in a purported class, collective, consolidated, mass, or representative proceeding.
The arbitrator may not consolidate the claims of multiple persons or preside over a class, collective, consolidated, mass, or representative proceeding except where applicable law requires otherwise or the parties expressly agree.
31. Jury Trial Waiver
To the fullest extent permitted by applicable law, for disputes validly subject to binding arbitration, you and Epic acknowledge that arbitration replaces the right to have those disputes decided in court by a judge or jury.
32. Small Claims
Nothing in the arbitration provisions prevents either party from bringing an individual claim in a court of competent small-claims jurisdiction when the claim qualifies and applicable law permits that proceeding.
33. Attorneys’ Fees and Costs
Except where a Client Agreement provides otherwise or applicable law authorizes an award of attorneys’ fees or costs, each party will bear its own attorneys’ fees and expenses relating to a dispute.
An arbitrator or court may award fees, costs, or other amounts when authorized by applicable law, a valid Client Agreement, or a legally enforceable provision governing the dispute.
34. Time Limit for Certain Claims
To the fullest extent permitted by applicable law, any claim arising solely from use of the Site or these Terms must be commenced within one (1) year after the claimant knew or reasonably should have known of the facts giving rise to the claim, unless applicable law requires a longer period that cannot validly be shortened by agreement.
This section does not alter limitation periods established by a Client Agreement or limitation periods that applicable law does not permit the parties to modify.
35. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or limited to the minimum extent necessary, and the remaining provisions will remain in effect.
36. No Waiver
A failure or delay by Epic in exercising or enforcing any provision, right, or remedy under these Terms does not constitute a waiver of that provision, right, or remedy.
37. Assignment
You may not assign or transfer rights or obligations under these Terms without Epic’s prior written consent where such restriction is permitted by applicable law.
Epic may assign or transfer its rights or obligations in connection with a merger, acquisition, restructuring, financing, reorganization, sale or transfer of assets or business operations, or similar transaction, subject to applicable law.
38. Changes to These Terms
Epic may revise these Terms periodically to reflect changes in the Site, Services, technology, business operations, risk practices, or applicable legal requirements.
The version posted on this page will display the applicable effective or updated date.
Where applicable law requires additional notice or consent for a particular change, we will provide it as required.
39. Entire Terms for Site Use
These Terms, together with policies expressly incorporated by reference, constitute the general agreement between you and Epic concerning use of the Site.
These Terms do not replace a valid Client Agreement governing paid Services, except where that agreement expressly provides otherwise.
40. Survival
Provisions that by their nature should survive termination or discontinuation of Site use will survive, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and accrued rights.
